The High Representative of the European Union (EU) for Foreign Affairs and Security Policy, Kaja Kallas, has stated that the International Criminal Court (ICC) is under “strong pressure” and emphasized the importance of protecting the court.
“Elchi” reports that Kallas spoke at an event titled “Humanitarian Diplomacy in Protecting International Humanitarian Law” held at the UN Headquarters in New York, within the framework of the 81st session of the UN General Assembly.
Noting the importance of the principle of accountability in the application of international humanitarian law, Kallas stated that existing mechanisms must be protected and emphasized the necessity of defending international courts—including the International Court of Justice (ICJ) and the ICC—alongside national courts.
“Contrary to what it should be, the ICC is currently under strong pressure,” Kallas said.
Emphasizing that the pressure exerted on the ICC and its judges is not limited to just one institution, Kallas noted: “These actions raise questions about the commitment to the international legal order established after the Second World War.”
Kallas specifically emphasized the necessity of protecting the ICC.
“The problem is not with the law, but with impunity”
Noting that international law is more developed and accessible than ever before, Kallas stated: “The problem is not with the law, but with impunity. And impunity leads to new cases of impunity.”
Kallas noted that judicial mechanisms must be defended and that new mechanisms should be created in cases where existing ones are insufficient.
“Where there is a will to ensure justice, there is always a way.” Kallas drew attention to the importance of collecting and preserving evidence for the proper construction of legal cases.
