The vehicle brought to and kept at the impound lot will be returned to its owner immediately after the established fee is paid.
According to “Elchi”, this is reflected in the amendment to the Law “On Road Traffic,” for which President Ilham Aliyev signed a decree on its implementation.
It should be noted that, according to the requirements of Articles 97.1 and 97.2 of the Code of Administrative Offenses, one of the conditions for the return of impounded vehicles to persons who have committed administrative offenses related to the violation of stopping or parking rules (in cases where the person who committed the administrative offense provided for in Articles 346.1, 346.2, or 346.4-346.9 is not present with the vehicle and the vehicle creates an obstacle to traffic and pedestrian movement) and violation of parking rules (Article 346-1.5) is the payment of the fee for bringing the vehicle to the impound lot and keeping it there.
According to the amendment to the Law “On Road Traffic,” the vehicle will be returned to its owner immediately after the owner pays the fee in the amount determined by the body (institution) defined by the relevant executive authority for bringing the vehicle to the guarded impound lot of the body (institution) defined by the relevant executive authority and keeping it there. If the vehicle was impounded illegally or if material damage was caused to it as a result of improper storage, the vehicle owner may file a complaint through administrative channels or to the court.
The fee for keeping a vehicle brought to a guarded impound lot will begin to be calculated from 00:00 on the day following the day the vehicle was brought to the guarded impound lot. In the event that the proceedings on the administrative offense that caused the vehicle to be taken to the guarded impound lot are terminated, or if a complaint against the decision on the imposition of an administrative penalty for the offense is granted, the amount of the fee paid for bringing the vehicle to the impound lot and keeping it there will be returned to the vehicle owner in the manner determined by the body (institution) defined by the relevant executive authority.
