The State Social Protection Fund under the Ministry of Labor and Social Protection of the Population has clarified the rules for the restoration and reassignment of previously assigned labor pensions.
According to information provided by the DSMF to elchi, the restoration and reassignment of a previously assigned labor pension are carried out within five years from the date of cessation of payment of the labor pension due to the expiration of the disability period, in relation to labor pensions assigned due to disability resulting from general illness.
It was stated that if disability occurs again after more than 5 years, the labor pension due to disability is assigned on general grounds. Also, the restoration of a previously assigned labor pension due to disability for other reasons is not limited by time.
The restoration and reassignment of previously assigned labor pensions are carried out electronically, and if this is not possible, by the relevant structural units of the Fund under the Ministry of Labor and Social Protection of the Population or by the “DOST” centers of the Sustainable and Operative Social Provision Agency, by the citizen or their representative personally visiting the service location with the necessary documents.
“The users of this service are citizens of the Republic of Azerbaijan and foreigners and stateless persons permanently residing in the Republic of Azerbaijan.
Applications for the restoration and reassignment of previously assigned labor pensions are reviewed in accordance with the legislation, and a relevant decision is made. Specifically, the labor pension due to disability is restored if no more than five years have passed since the date of cessation of payment of the labor pension due to the expiration of the disability period.
If disability occurs again after more than 5 years, the person’s right to a labor pension due to disability is re-examined, and in this case, a new labor pension is assigned if the person has the right to a pension due to disability. If the right to a pension is not established, a decision to refuse the assignment of a pension is made, and information is sent in the prescribed manner to one of the contact methods indicated in the application,” the DSMF statement reads.
