Insurance payments will be paid not based on the determination of the insured’s disability, but in accordance with the degree of loss of professional working capacity.
“Elchi” reports that this is reflected in the proposed amendment to the Law “On compulsory insurance against loss of professional working capacity as a result of industrial accidents and occupational diseases,” which was discussed at today’s meeting of the Labor and Social Policy Committee of the Milli Majlis.
The degree of loss of professional working capacity is the percentage expression of the permanent loss of professional working capacity that the insured possessed until the insurance event occurred. In this regard, in order to evaluate the provision of insurance payments for an insurance event according to a unified criterion, it is proposed to link the lump-sum insurance payment not to the determination of the disability of the insured person injured as a result of the insurance event, but to the degree of loss of professional working capacity. That is, the lump-sum insurance payment will be carried out when the degree of loss of professional working capacity of the insured person injured as a result of the insurance event is determined without indicating the next examination period.
It was noted that the loss of professional working capacity also includes the determination of disability, that is, the loss of body functions. This amendment is also in line with the requirements of Article 4 of the International Labour Organization Convention No. 187 “Concerning the Promotional Framework for Occupational Safety and Health”.
