The Cabinet of Ministers has made amendments to a number of normative legal acts regarding the circulation, advertising, and waste management of electronic cigarettes, including non-nicotine devices.
“Elchi” reports that Prime Minister Ali Asadov has signed a decree to this effect.
One of the main changes concerns the field of advertising. According to the addition to the “List of goods prohibited from advertising,” the advertising of electronic cigarettes that do not contain nicotine is now strictly prohibited. Thus, nicotine and non-nicotine devices have been equalized in terms of advertising bans.
According to the decision, the words “electronic cigarettes for single use” have been removed from the list of excise rates and commodity nomenclature of certain excisable goods imported into the territory of Azerbaijan, and the relevant sub-headings have been abolished. This change provides for the alignment of taxation and import duties for disposable electronic cigarettes with the new classification.
The new rules aim to minimize the environmental impact of electronic cigarette waste. Thus, “nicotine-containing electronic cigarettes” have been added to the “Rules for the utilization of tobacco product waste.” This means that the waste from these devices must be managed in the same way as tobacco products, in accordance with special utilization requirements.
At the same time, the words “electronic cigarettes” have been removed from the requirements for designated smoking areas, creating a legal basis for these devices to be subject to different regulations or broader bans.
Technical clarifications have also been made to the list of goods that must be marked with excise stamps and mandatory labeling. Disposable electronic cigarettes have been removed from some registration lists and included in the list of goods subject to technical regulation as individual electric vaporizing devices (under code 8543 40 000 0).
It should be noted that this decision was adopted to ensure the implementation of the Decree of the President of the Republic of Azerbaijan dated January 26, 2026, and enters into force from the day it is signed.
