The responsibility of officers, sergeants, midshipmen, and military personnel serving beyond their term is increased, and alternative punishment is defined.
elchi reports that this is reflected in the proposed amendment to the Code of Administrative Offenses, which was put up for discussion at the meeting of the Milli Majlis Committee on Legal Policy and State Building held today.
The draft law states that the absence of such persons from the military unit or place of service for more than one day will result in administrative responsibility.
Specifically, if an officer, sergeant, midshipman, or military personnel serving beyond their term leaves the military unit or place of service without authorization, or fails to arrive at the military unit or place of service on time without valid reasons, and this violation lasts for more than one day but not more than ten days, they will be fined from two hundred to three hundred manats or subjected to administrative arrest for up to fifteen days, taking into account the circumstances of the case and the identity of the offender.
According to the current Code, such an offense is punishable by administrative arrest for up to twenty days.
For repeated commission of such acts by a person who has been subjected to administrative punishment, within one year from the date the decision on administrative punishment takes effect, a fine of three hundred to five hundred manats will be imposed, or administrative arrest for a period of ten days to one month will be applied, taking into account the circumstances of the case and the identity of the offender. According to the current Code, administrative arrest for such an administrative offense is applied for a period of fifteen days to one month.
It was noted that along with the increase in responsibility, the softening of the sanction and the definition of an alternative punishment (fine) can be considered a progressive step.
