The Supreme Court has issued a warning to citizens regarding money given for illegal purposes.

“It is evident from judicial practice that sometimes individuals give money or other property to someone with the aim of achieving an illegal result. When promises are not fulfilled, claims for the return of the given money are usually filed in civil court. However, as a rule, it is not possible to recover that money through court proceedings. During the legal assessment of any claim in civil court proceedings, the first step is to find the legal basis corresponding to the plaintiff’s claim. In civil law, for any monetary claim to be satisfied, that claim must arise from a contract, the infliction of damage, unjust enrichment, or other grounds provided for by law,” the court’s statement says.
It is noted that money given for illegal purposes is not based on any legal grounds: “The legal system protects only legal relations. If money is given for an illegal purpose, that relationship is no longer considered a civil legal relationship protected by law. In cases of this category, courts first investigate the purpose for which the money was given. This is because, in order to use legal protection, the relationship itself must be based on legal and legitimate grounds from the outset. If it is determined that the parties acted with the intention of achieving an unlawful result, the claim is not satisfied. Furthermore, in such cases, individuals may face not only the risk of losing money but also additional negative legal consequences. When signs of a violation of the law appear in the case materials, the courts may adopt a special ruling and send the materials to the prosecutor’s office for procedural assessment.
To avoid these risks, citizens are advised to establish their legal relations only on legal and legitimate grounds and to refrain from illegal relations.”
