Rules for acquiring land for metro and railway projects are being improved

Land plots necessary for the construction, installation, and expansion of tunnels, including metro tunnels, railway, metro, and tram lines, stations, and depots, will be acquired for state needs.

“Elchi” reports that this is reflected in the proposed amendments to the law “On the Acquisition of Land for State Needs,” discussed at today’s Milli Majlis session.

Corresponding amendments are also proposed to the Civil Code.

Thus, amendments to the legislation are proposed to ensure the timely and efficient implementation of metro and railway infrastructure development in Azerbaijan, as well as large-scale projects in this field. The project aims to legally ensure the unimpeded implementation of strategically important state projects related to metro and railway infrastructure.

It was noted that the “State Program for 2025-2030 for the Improvement of Transport Infrastructure in Baku City and its Surroundings” was approved by the President’s decree dated January 30, 2025, to improve transport infrastructure in Baku city and its surrounding areas. The State Program envisages measures related to the renewal of vehicle fleets, as well as the construction of new depots, stations, and lines, and the restoration and improvement of existing infrastructure.

The main goal of the draft law is to improve the legislative framework regulating the procedures for acquiring land plots for state needs.

The amendments specifically provide for a more precise and unambiguous application of legal mechanisms when acquiring land plots for state needs, necessary for the construction, restoration, and improvement of tunnels, including metro tunnels, railway, metro, and tram lines, stations, and depots.

It is stated that the proposed amendments will serve to accelerate the expansion of important transport and communication projects, especially metro and railway infrastructure, and increase legal certainty and transparency in the process of acquiring land for state needs.

The project also aims to balance state and public interests within the legal framework.

The draft law was put to a vote and adopted in the first reading.
