The “Model Regulation on Technology Parks” has been amended

President Ilham Aliyev has amended the “Model Regulation on Technology Parks” approved by the decree dated May 15, 2014.

“Elchi” reports that the head of state has signed a new decree in this regard.

According to the decree, from now on, a legal entity carrying out entrepreneurial activity (providing goods, works, and services to technology park residents) on the territory of the technology park based on a lease agreement for the technology park’s infrastructure with the managing organization (or with the operator regarding infrastructure facilities owned by the operator), or an individual entrepreneur carrying out entrepreneurial activity without creating a legal entity, will be considered a non-resident of the technology park.

Unless otherwise provided in the management agreement, upon the expiration of the agreement, the infrastructure facilities owned by the operator may be transferred to the ownership of the managing organization based on the handover procedure determined in the management agreement, taking into account the rights and encumbrances of third parties, based on the mutual agreement of the parties or the compensation terms stipulated in the agreement.

Production facilities, equipment, and installations built at the expense of the technology park resident for the purpose of conducting scientific research and experimental design work are considered the property of the resident.

In addition, the following new concepts have been introduced into the Regulation:

digital technology – technological solutions that ensure the creation, collection, processing, storage, transmission, and use of information in digital form, which is a set of software, hardware, tools, telecommunication networks, and related systems, serving for the automation, optimization, and innovative development of economic, social, and management activities;

artificial intelligence technology – an algorithmic system or a combination of such systems that performs functions requiring human intelligence (forecasting, planning, classification, pattern recognition, organization and perception, speech, voice, and image recognition, text, voice, and image generation, language translation, communication, learning, problem-solving, etc.) using statistical or other mathematical techniques, thereby creating results such as content, probability, advice, or decisions that affect the environments they interact with within the framework of goals defined by humans, assisting or replacing human decision-making and other processes;

innovation product – a product (work, service) or technological solution that is aimed at overcoming technological uncertainty, is newly created or significantly different (fundamentally improved) in its properties, application area, and/or form of use from previous ones, provides economic, social, or environmental benefits, has been presented to the consumer (brought to market) or applied in practice, or is confirmed by a document certifying its registration as a patent (invention, utility model, industrial design, etc.) in accordance with normative legal acts;

c ybersecurity – protection of information infrastructure from cyber threats, cyberattacks, and cyber incidents, and ensuring its cyber resilience (resistance to cyber incidents, ability to maintain operations during such incidents, and rapid recovery afterward);

scientific research, design and experimental design work – activity aimed at overcoming existing scientific or technological uncertainties in the field of science and technology, acquiring new knowledge, as well as creating new or significantly improved technologies, software, products, services, and processes, and which collectively meets the criteria of novelty, creativity, systematicity, and reproducibility (transferability);

cloud computing services – the activity of providing remote access via the Internet or other telecommunication networks to a common pool of configurable computing resources such as networks, servers, data storage systems, and other computing resources, including software, applications, platforms, as well as service models such as infrastructure as a service, platform as a service, and software as a service, in accordance with the user’s request.
