The provision (restriction) of the law “On E-commerce” stipulating its application only to e-commerce carried out within the country is being lifted.
elchi reports that this issue is reflected in the proposed amendment to the law “On E-commerce” discussed at today’s meeting of the Milli Majlis Committee on Economic Policy, Industry and Entrepreneurship.
According to the draft, the concept of “technological neutrality” and the relevant principle are being introduced into the law “On E-commerce”. Technological neutrality means that in e-commerce relations, no technology is preferred in the normative legal acts in this field, no restrictions are imposed on its application, and various technological solutions are accepted equally.
The concept of “POS terminal” is being clarified and adapted to current practice. Currently, according to the legislation, a POS terminal is equipment intended for carrying out operations with payment cards, as well as for obtaining cash. According to the draft, a POS terminal will be considered equipment intended for carrying out non-cash payments (including contactless payments) and (or) for obtaining cash, including a mobile device equipped with the necessary software (a telephone set and other terminal equipment receiving (or capable of receiving) mobile (cellular) service on the public telecommunication networks of mobile operators).
At the same time, provisions related to payment are being improved, and some adaptive changes are being made due to the improvement of payment methods in the field of e-commerce.
