Clergy, individuals who have accepted the citizenship of another state and (or) have obligations to other states, including individuals who are not suitable for service in state bodies due to illnesses, the list of which is determined by the body (institution) defined by the relevant executive authority, will not be able to hold public service positions.
According to “Elchi”, this is reflected in the draft Law on Public Service discussed at today’s session of the Milli Majlis.
According to the current law “On Public Service”, any person cannot be accepted for public service in the following cases:
– if their legal capacity or limited legal capacity is confirmed by a court decision;
– if their criminal record has not been paid off or removed;
– if there is a close kinship or in-law relationship (spouses, their parents, brothers, sisters, children) with a public servant who will work directly under their subordination or control;
– if there is a court decision that has entered into legal force regarding the application of compulsory measures of a medical nature against them;
– in other cases established by law.
According to the draft, the following persons cannot hold public service positions:
– persons who have accepted the citizenship of another state and (or) have obligations to other states;
– persons whose legal capacity or limited legal capacity has been confirmed by a court decision that has entered into legal force;
– persons with an unpaid or unremoved criminal record;
– persons against whom there is a court decision that has entered into legal force regarding the application of compulsory measures of a medical nature;
– persons who are not suitable for service in state bodies due to illnesses, the list of which is determined by the body (institution) defined by the relevant executive authority;
– persons dismissed from public service due to non-performance or improper performance of service functions and duties, and non-compliance with established restrictions (within 6 (six) months);
– clergy.
It should be noted that, as in the law “On Public Service”, the draft Law on Public Service also maintains the restriction related to the age of 65.
The draft law was put to a vote and adopted in the third reading.
