Religious figures, persons who have accepted the citizenship of another state and/or have obligations to other states, as well as persons who are not suitable for service in state bodies due to diseases determined by the body (institution) defined by the relevant executive authority, will not be able to hold civil service positions.
According to the news from “Elchi”, this is reflected in the draft Civil Service Code, which was discussed at today’s meeting of the Legal Policy and State Building Committee of the Milli Majlis.
According to the current Law “On Civil Service”, a person cannot be admitted to the civil service in the following cases:
– if their lack of legal capacity or limited legal capacity is confirmed by a court decision;
– if their conviction has not been cleared or expunged;
– if there is a close kinship or affinity (spouses, their parents, brothers, sisters, children) with a civil servant under whose direct supervision or control they will work;
– if there is a legally binding court decision on the application of compulsory medical measures against them;
– in other cases established by legislation.
According to the draft, the following persons cannot hold a civil service position:
– persons who have accepted the citizenship of another state and/or have obligations to other states;
– persons whose lack of legal capacity or limited legal capacity has been confirmed by a legally binding court decision;
– persons whose conviction has not been cleared or expunged;
– persons against whom there is a legally binding court decision on the application of compulsory medical measures;
– persons who are not suitable for service in state bodies due to diseases determined by the body (institution) defined by the relevant executive authority;
– persons whose civil service has been terminated due to non-performance or improper performance of service functions and duties, or failure to comply with established restrictions (within 6 (six) months);
– religious figures.
It should be noted that, as in the Law “On Civil Service”, the restriction regarding the age of 65 is maintained in the draft Civil Service Code.
