New regulation on psychiatric examination has been established

A new regulation on psychiatric examination has been established.

According to the news from elchi, this is reflected in the amendments to the Law “On Psychiatric Care” approved by President Ilham Aliyev.

According to the law, articles 19.2-1 and 17.4 have been added to the aforementioned law in order to ensure the health and safety of the person with a mental disorder, as well as other persons.

In this regard, a new article 17.2.5 has also been added to the law regarding the conduct of psychiatric examination without the consent of persons with mental disorders or their legal representatives.

At the same time, it is intended to amend Article 25.1 of the law regarding the decision of a psychiatrist on the involuntary placement of persons in this category in a psychiatric hospital until a court decision is made, and the immediate notification of the close relatives and legal representatives of these persons, the prosecutor, or the relevant authorized person by the head of the psychiatric institution.

In addition, the draft includes provisions added to Articles 7.2, 7.5, and 10.2 of the Law regarding the storage of information about the health status of a person with a mental disorder and the psychiatric care measures provided to them in the electronic health card system, the acquisition of information about the care measures provided to the aforementioned person by the person themselves from the electronic health card system, and the provision of the mentioned information to the legal representative of that person by the institution’s administration within 2 working days after their written application; as well as the entry of information regarding the refusal of treatment into the electronic health card system.

At the same time, according to the decree signed by President Ilham Aliyev on the application of the law, the Cabinet of Ministers must approve the regime rules and the limits of security measures during compulsory hospitalization (compulsory medical measures) in a psychiatric institution under the Law “On Psychiatric Care” within three months and inform the President of the Republic of Azerbaijan.

In addition to the above, it is intended to add new articles 12.4 and 24.2-1 to the law for the purpose of isolating and treating persons involved in compulsory medical measures who pose a danger to themselves or others from other patients and ensuring regime rules.
