State control over transferred administrative fines has been increased; “ICMAL” will become a subsystem of “Digital Public Finance”.
According to the news from “Elchi”, this is reflected in the amendment to the Code of Administrative Offenses, for which President Ilham Aliyev signed a Decree on its implementation.
According to the law, the “ICMAL” information system will be reorganized as the “Central Automated Board of Administrative Fines” subsystem, i.e., the “ICMAL” subsystem, within the “Digital Public Finance” information system, and corresponding amendments will be made to the relevant articles of the Code of Administrative Offenses. This transformation will ensure the integration of data analysis on administrative fine revenues and control functions over the accuracy of that data into a unified state financial platform.
The “ICMAL” subsystem will ensure the analysis of data and the exercise of control over the accuracy of information regarding the portion of fines imposed under the Code of Administrative Offenses that is calculated and transferred to the state budget and/or to the accounts of the authorized bodies (institutions) that issued the decision (electronic decision) on the application of an administrative penalty in the form of an administrative fine.
Furthermore, the project provides for certain improvements regarding the official delivery of documents on administrative offense cases. According to the project, the decision on the application of an administrative penalty or the protocol on an administrative offense regarding traffic rules, road safety, and the use of highways, directly detected by an authorized body (official), will be officially delivered by presenting a paper copy on the spot to the person against whom the proceedings on the administrative offense case are being conducted.
In addition, the law stipulates that a person who is alleged to have suffered moral, physical, or material damage from the act provided for by law may participate in the proceedings on administrative offense cases as the legal representative of that person.
