INNOVATION in property turnover between state bodies

A new procedure has been established for the transfer of fixed assets owned by the state, including buildings and non-residential premises, between state bodies financed from the budget.

elchi reports that this is reflected in the amendment to the “State Program on Improvement of State Property Management in the Republic of Azerbaijan” made by the Decree signed by President Ilham Aliyev.
Until now, the transfer of state-owned fixed assets, including buildings and non-residential premises, between state bodies financed from the budget was carried out based on decisions adopted by the Cabinet of Ministers, except for cases determined by the President of the Republic of Azerbaijan.

According to the amendment, the transfer of state-owned fixed assets with an initial value of more than 5,000 (five thousand) manats per unit (set) between separate state bodies and state-owned legal entities (excluding the transfer of fixed assets between state-owned legal entities under the same state institution) will be carried out based on decisions adopted by the Cabinet of Ministers after obtaining the opinion of the State Service for Property Issues under the Ministry of Economy, except for cases determined by the President of the Republic of Azerbaijan, including cases where the Ministry of Justice resolves issues related to the financial and other material-technical support of courts of first instance in accordance with the Law “On Courts and Judges”. The transfer of state-owned fixed assets with an initial value of 5,000 (five thousand) manats or less per unit (set) between separate state bodies and state-owned legal entities will be carried out based on the decisions of those state bodies and state-owned legal entities after obtaining the written consent of the State Service.

The transfer of fixed assets by the Ministry of Justice to courts of first instance for the purpose of financial and other material-technical support of courts of first instance in accordance with the Law “On Courts and Judges” will be carried out in the manner established by clause 6.9 of the State Program. According to clause 6.9 of the State Program, the transfer of fixed assets from one structural unit to another within the same central or local executive authority, as well as state organizations, is carried out based on the decision of that central or local executive authority or state organization after obtaining the written consent of the State Service.
