As a result of monitoring and analysis conducted by the Food Safety Agency of the Republic of Azerbaijan (AQTA) in the soft drinks market, it has been determined that the visual and textual elements used in the labeling, packaging, and advertising of some soft drinks create a false perception among consumers that these products are energy drinks.
AQTA provided this information to “Elchi”.
It was stated that the presentation of such products utilizes depictions, symbols, animal imagery, names, and other design elements that convey concepts such as aggression, power, dominance, high physical performance, speed, and superiority. At the same time, the inclusion of athletes and individuals with high physical activity in advertising materials can create a false impression among consumers that the product is an energy or sports drink:
“During the monitoring, it was determined that the packaging of some soft drinks also includes warnings and restrictions intended for energy drinks. Specifically, phrases such as ‘Sale to persons under 18 is prohibited’, ‘Should not be used together with or mixed with alcoholic beverages’, ‘Not recommended for pregnant and lactating women, as well as persons with certain diseases’, and ‘Daily consumption of more than 500 ml is not recommended’ are found on the products. However, these warnings are specific requirements established only for energy drinks, and their use on ordinary soft drinks can lead to the deception of consumers.”
AQTA brings to the attention of manufacturers, importers, and advertising entities that visual and textual elements that mislead consumers or create a false perception regarding the actual characteristics of the product should not be used in the labeling, packaging, and advertising of products.
“Consumers are advised to read label information carefully when purchasing products. It is important to pay attention to the presence of the ‘Energy drink’ label on the packaging to determine whether the product is an energy drink,” the statement emphasized.
