Those who violate the legislation on private enforcement officers will be fined.
According to the news from “Elchi”, this is reflected in the new Article 528-3 added to the Code of Administrative Offenses, approved by President Ilham Aliyev.
According to the Code, a person who performs the activities of a private enforcement officer without taking an oath in accordance with the law on “private enforcement officers” and whose information is not entered into the Register of Private Enforcement Officers will be fined in the amount of one thousand five hundred manats. For illegally wearing the uniform and (or) the badge of a private enforcement officer, a fine of five hundred to seven hundred manats will be imposed, with the confiscation of the uniform and special badge that were the object of the administrative offense. Failure by private enforcement officers to notify the body maintaining the register about changes in the information contained in the Register of Private Enforcement Officers within 3 (three) working days will result in a fine of five hundred manats.
Starting work as an assistant to a private enforcement officer without having one’s information entered into the Register of Private Enforcement Officers will result in a warning or a fine of five hundred manats. An assistant to a private enforcement officer who independently engages in the activities of a private enforcement officer or carries out enforcement actions will be fined in the amount of one thousand five hundred manats.
For interfering with the lawful activities of a private enforcement officer in connection with the execution of enforcement documents, individuals will be fined in the amount of two hundred to three hundred manats, officials in the amount of four hundred to six hundred manats, and legal entities in the amount of eight hundred to one thousand two hundred manats.
Private enforcement officers will be fined in the amount of five hundred to one thousand manats for obtaining information from state and other information resources and systems that is not necessary for the implementation of enforcement actions.
These measures will be applied if the specified acts do not result in criminal liability under the relevant articles of the Criminal Code.
