Creating a terrorist organization, or leading that organization or its structural unit, will be punished with imprisonment from 10 to 14 years.
According to “Elchi”‘s report, this is reflected in the new Article 214-4 proposed to the Criminal Code, which was discussed at today’s meeting of the Milli Majlis Committee on Defense, Security and Anti-Corruption.
According to the draft, membership in a terrorist organization or participation in its activities will be punished with imprisonment from 7 to 12 years.
The note section of the article stipulates that a person who is a member of a terrorist organization or participates in its activities is exempted from criminal liability if they, by timely informing the authorities or by other means, help prevent criminal acts, assist in the detection of persons who created, led, participated in the activities of, or financed a terrorist organization, and if there is no other criminal offense in their actions.
In addition, technical changes are envisaged in Articles on financing terrorism (214-1) and public calls for terrorism (214-2) of the Criminal Code, as well as in Article 1 of the Law “On Combating Terrorism”.
According to the draft law, Article 282 of the Criminal Code is presented in a new version. Thus, new objects are added to Article 282.1, such as the purpose of weakening scientific and technical potential, as well as the disruption of the normal functioning of critical information infrastructure, energy, transport, and telecommunication networks. Also, methods of committing sabotage now include cases of using practical artificial intelligence technologies and special software. According to the draft, Article 282.2 envisages several new aggravating circumstances. These aggravating circumstances include sabotage committed by a criminal association, during a state of emergency or martial law, a social emergency regime, as well as during mass riots, committed by a person using their official position, and causing human death or other severe consequences due to negligence. According to the Note section of Article 282, a person who participated in the preparation of sabotage is exempted from criminal liability if they, by timely informing the authorities or by other means, help prevent such an act, and if there is no other criminal offense in their actions.
