Demanding payment from students studying under state order is contrary to legislation – OFFICIAL

Demanding payment in any form from students studying under state order is contrary to legislation. The education expenses of such students are covered by the state budget, and no financial burden related to this can be placed on the student.

Regarding this, information was provided to “Elchi” by the State Agency for Science and Higher Education.

It was stated that, in this regard, the private status of an educational institution does not change the legal regime established by the state regarding the financing of students admitted under state order. The internal financial planning of the educational institution, the management of allocated funds, or situations arising from unused funds at the end of the year do not create additional obligations for students. The student is not responsible for the consequences of improper regulation of financial matters by the university.

The appeal of the relevant higher education institution regarding the issue was reviewed in accordance with the requirements of the legislation and an official response was provided. It was stated that, according to Article 19.5 of the Law of the Republic of Azerbaijan “On the Budget System”, the return of unused funds transferred to the single treasury account at the end of the year is not possible within the powers of the Ministry of Science and Education.

It should be noted that, according to information disseminated on social networks, additional payment was demanded from students studying under state order at Western Caspian University.
